Terms and Conditions

OVERVIEW
Re.Turn It Collectis an on-demand beverage container return service operated by Re.Turn It Collect Pty Ltd (ACN 626 032 291) (“Re.Turn It Collect”), which allows you to arrange for pickup of eligible containers which are then delivered to a container deposit/refund scheme collection point in exchange for a fee paid to Re.Turn It Collect (“the Service”).  The Service is being offered on a pilot basis to selected suburbs only.  The container deposit/refund scheme is operated by the operator of the scheme through its network of collection points.  If you do not wish to use the Re.Turn It Collect Service, you can go directly to a collection point to redeem a refund amount of 10 cents.  Information on the locations of collection points in your jurisdiction can be found on the Re.Turn It website.

To use the Service, you apply to register as a participant in the Re.Turn-It Collect system through our website (re-collect.com.au), mobile application on Android or iOS (“the Mobile App”) or the Re.Turn It Collect web application (app.re-collect.com.au) (“the Web App”) (these three together constitute the “System”) .

The System is operated by Re.Turn It Collect. Throughout these Terms and Conditions, the terms “we”, “us” and “our” refer to Re.Turn It Collect.  Before you register, you must acknowledge that you have read and agree to these Terms and Conditions. By signing up through the System, you acknowledge that you have read and agree to these Terms and Conditions and clicking “sign up” constitutes your agreement to follow and be bound by the most recent version of these Terms and Conditions. If you do not understand any of these terms, please contact us at collect@re-collect.com.au before proceeding. If you still do not agree to all the terms and conditions of this agreement, then you should not access the System or use the Services.

We will post all modifications of these Terms and Conditions on the System. Please check them whenever you access and use the System. You can tell when these Terms and Conditions were last modified by checking the “last updated” date.  Any new features which are added to the Service or the System shall also be subject to these Terms and Conditions.

RE.TURN IT COLLECT’S ROLE
Re.Turn It Collect acts as a service provider which arranges for containers to be collected from customers and dropped to a collection point.  The operator of the scheme is a separate legal entity and is not controlled by Re.Turn It Collect, nor is Re.Turn It Collect controlled by the operator. Re.Turn It Collect is not a collection point as defined in the relevant legislation.

COST OF SERVICE
Re.Turn It Collect will provide you 10 cents per eligible container that we collect from you. We charge you a service fee of 5 cents per eligible container for the Service and you instruct Re.Turn It Collect to deduct this service fee from the payment of 10 cents per eligible container. Therefore, Re.Turn It Collect will electronically pay you 5 cents per eligible container returned. Information on eligible containers in your jurisdiction can be found on the Re.Turn It website.

MINIMUM QUANTITY
The minimum number of eligible containers that Re.Turn It Collect will accept for a single pickup is 100.  If it is found that a pickup contains less than 100 eligible containers, we may not pay you the refund amounts on that pickup. This number may be changed from time to time, as shown in the most recent version of these Terms and Conditions.

ABILITY TO ENTER INTO THESE TERMS AND CONDITIONS
In order to enter into these Terms and Conditions, you must be at least 18 years old and fully able and competent to enter into the contract, and able to abide by and comply with these Terms and Conditions. If you accept these Terms and Conditions, you expressly represent that you have the capacity to be bound by them.

GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service or the System, use of the Service, or access to the Service or any contact on the System through which the Service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms and Conditions.

HOW THE SERVICE WORKS
You can schedule pickups using the System. Drivers will pick up containers and transport them to another location where they will be counted and sorted. Container counts and deposit values will be credited to your online account or directly to your nominated charity. Upon registration, you create a unique online account, linked to your email address. The email address is the unique account identifier which allows you to access certain areas of the System and represents your online account. You may schedule up to one pickup at any point in time from the System. After scheduling a pickup, you will place bags of containers outside your home on the morning of the pickup, providing specific instructions on where to find the bags, if necessary. The bag/s must be placed in a secure and safe location and any pets or other animals must be secured.  The Driver may refuse to collect the bag/s if he/she does not feel safe at the pickup location. Drivers will drive optimised pickup routes to collect containers. On each pickup, the driver will uniquely label your bags of containers. When finished, these containers are transported, along with other customer bags, to a sorting and counting location. After pickup, you can expect your containers to be counted within a few business days. You will be notified via email when your containers have been counted. Your account will then show your deposit amount on all eligible beverage containers found for that pickup. PICKUPS
Our pickup services can be requested online through the Web App and Mobile App. The Service is being offered on a pilot basis to selected suburbs only.  This Service may have limited availability and is not guaranteed to be available when requested. We make every effort to ensure timely pickups. We reserve the right, but are not obligated, to limit our Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of services that we offer. We reserve the right to refuse any pickup you request from us. We may, in our sole discretion, limit or cancel pickups requested per person or per pickup location. These restrictions may include pickups placed by or under the same customer account, and/or pickups that use the same address. In the event that we make a change to or cancel a pickup, we may attempt to notify you by contacting the e-mail and/or phone number provided at the time the pickup request was made. You agree that you will not pass ownership of the containers directly to the driver or other person picking up containers and will utilise the Service as intended by providing containers to Re.Turn It Collect in exchange for payment of a refund amount prescribed by regulations for the containers. You acknowledge that if you do not wish to use the Re.Turn It Collect service, you can go directly to a collection point within your jurisdiction.

CONTAINER COUNTS
We will do our utmost to ensure your container counts are accurate. Containers may be counted manually or via automated counting systems. The counts of the beverage containers performed by the operator of the container deposit/refund scheme system, staff, and partner network are stored in their database. All counts are considered final; however, you can contact us for further information if you have a query about counts and we will use reasonable efforts to resolve your query.

REDEMPTION
Redemption of funds from your account to your bank account is subject to any minimum amounts we may set from time-to-time in the most recent version of these Terms and Conditions.  Upon your request, the funds in your account will be paid out via electronic funds transfer to your nominated bank account. If you request redemption through the System before our cut-off time for processing, the transfer will be initiated the same day (provided it is a business day) and if not, will be initiated on the next business day.  We reserve the right, at any time in our sole discretion, to make changes to the redemption options available as part of the Service. This is a cashless system; drivers are not able to issue refunds on-the-spot.

THEFT
We are able to offer efficient and convenient pickup services by not requiring customer hand-off of containers on pickup. However, this creates a potential opportunity for theft. Customers are responsible for preventing theft by securing their containers on their property until our driver completes the pickup. Re.Turn It Collect will not be held liable for any theft of containers prior to pickup.

GARBAGE
When garbage or non-eligible containers are mixed in with refundable containers, it makes the container refund process extremely inefficient. Efficiency is one of the primary reasons we are able to offer such low fees for pickups. It is paramount that you keep garbage separate from your refundable containers to keep the Re.Turn It Collect system running efficiently for all. If a driver suspects that garbage is present within a bag, he/she may refuse to pick up the bag and therefore those containers will not be processed. We reserve the right to, at our sole discretion, charge $0.10 for each piece of ineligible material or garbage found with your refundable containers.

PERMISSION TO ENTER PREMISES
By scheduling a pickup, you give permission to Re.Turn It Collectpersonnel (including its staff and contracted drivers) to enter your property for the purpose of collecting your beverage containers.

RIGHT TO CHANGE SERVICES AND FEES
We reserve the right, at any time in our sole discretion, to: (a) modify, suspend or discontinue any service, content, feature or product offered through Re.Turn It Collect, with or without notice; (b) charge fees in connection with the use of Re.Turn It Collect; (c) modify and/or waive any fees charged in connection with Re.Turn It Collect; and/or (d) offer opportunities to some or all users of Re.Turn It Collect. We will notify you through our Terms and Conditions or by other means of any changes to fees for the Service. You agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of Re.Turn It Collect or the Service, or of any service, content, feature or product offered through Re.Turn It Collect.

USER ACCOUNT
Re.Turn It Collect can terminate your account at any time. If Re.Turn Collect It terminates your account for any reason, the funds in your online account at the time of termination will be paid to you by electronic transfer to your nominated Australian bank account. You are responsible for ensuring the accuracy of your personal information for your on-line account, including your most current email, phone, mailing address and bank account details. If we discover that your contact details are inaccurate or you have not nominated an Australian bank account, we will donate the funds to a registered charity of our choice within three months.

PASSWORDS
You are solely responsible for maintaining the confidentiality of your password and user account information, if any. You must notify us immediately in the event of any known or suspected unauthorised use of your user account, or any known or suspected breach of security, including loss, theft, or unauthorised disclosure of your or anyone else’s password. If electronic fraud or identity theft has occurred, Re.Turn It Collect will, upon notification or discovery, freeze your on-line account until ownership can be confirmed.

THIRD PARTY TOOLS
We may provide you with access to third-party tools, such as Google Maps, over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of third party tools offered through the System is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

THIRD PARTY LINKS
The System may permit you to link to other websites or resources on the internet, and other websites or resources may contain links to the System. These other websites are not under Re.Turn It Collect’s control, and you acknowledge that Re.Turn It Collect is not responsible or liable for any third party content or any associated loss or damage. The inclusion of any such link does not imply endorsement by Re.Turn It Collect.

SERVICE AND SYSTEM CONTENT
We do not guarantee that the Service including the System will be free from typographical errors, inaccuracies, or omissions that may relate to pricing, promotions, offers, and availability. If we spot an error, we may correct it, update information or cancel orders where it is reasonable to do so.

The intellectual property that we own or are entitled to use includes but is not limited to:

  • the Re.Turn It Collect logos;
  • the System, including but not limited to its “look and feel” (e.g., text, graphics, images, logos, buttons, icons and the placement and layout);
  • images, video, audio, data, content, software (including html-based computer programs); and
  • other media, material or information.

Nothing in these Terms and Conditions, the Privacy Policy or your use of the System transfers any intellectual property rights to you.  The intellectual property is intended solely for personal, non-commercial use. You may not download or copy the content displayed on the System. You may not do anything which infringes our intellectual property rights (e.g. reproduce, distribute, display, or sell any of our intellectual property).

USER CONDUCT
You must not use the System in any way that causes, or is likely to cause, the System or access to it to be interrupted, damaged or impaired in any way. You must use the System for lawful purposes only. You understand that you are responsible for all electronic communications and content sent from your computer to us. Certain portions of the System may have functionality for material to be sent to you via email to addressees specified by you. By using this facility, you confirm that you have entered your correct email address or have the consent of the recipient to send such emails.

Harassment in any manner or form, including via e-mail or by obscene or abusive language is strictly forbidden. Impersonation of others, including any Re.Turn It Collect employee or driver or other members or users on the System is prohibited.

USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
We welcome your ideas, suggestions and feedback (Feedback) for improving the Service, but you do so voluntarily and on the basis and in the knowledge that we do not pay any compensation for such Feedback and we do not acknowledge intellectual property rights or ownership held by you in any aspect of the Feedback.

PERSONAL INFORMATION
Your submission of personal information through the System is governed by our Privacy Policy, which can be viewed by clicking on the “Privacy Policy” link located on the System (the Privacy Policy). These Terms and Conditions incorporate by reference the terms and conditions of the Privacy Policy.

DISCLAIMER
Re.Turn It Collect does not warrant that the System, System or any function contained in the System will be uninterrupted or error-free, that defects will be corrected, or that the System or the servers that make the System available are free of viruses or other harmful components.

LIABILITY
We, our employees and drivers are not liable for damage caused to or on your property except to the extent that there is evidence to prove that they are responsible for the damage.

We do our best to make our System work simply and effectively, but if you feel that you have suffered a loss through using it, you may have certain rights and remedies under the Competition and Consumer Act 2010(Cth) and other laws, which may imply certain conditions and warranties into this agreement. We do not exclude or restrict or modify those rights, remedies or implied conditions and warranties.

Where we are liable for any loss or damage in connection with or arising from the breach of any term, condition, warranty or remedy implied by the Competition and Consumer Act 2010(Cth) our liability is limited to the amount of your deposit or deposits directly related to your loss. You must let us know as soon as you become aware or believe that you have a claim against us. You indemnify us from and against all actions, claims, suits, demands, liabilities, losses, costs and expenses arising in any way whatsoever out of or in any way connected with your use of the System, Services, System in a manner contrary to these Terms and Conditions.

ASSIGNMENT
Re.Turn It Collect may assign its rights and obligations under these Terms and Conditions. You will be notified via email to the email address specified in your on-line account if Re.Turn It Collect assigns its rights and obligations under this Agreement. Only the assignee will have obligations to you under these Terms and Conditions from the effective date of the assignment as notified to you by email.

TERMINATION
These terms are effective unless and until terminated by either you or Re.Turn ItCollect. Re.Turn It Collect may deny you access to the System, if in its judgment you fail to comply with any term or provision of these Terms and Conditions. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of these Terms and Conditions. The clauses of these Terms and Conditions which ought reasonably to survive termination shall survive the termination or expiry of these Terms and Conditions. The determination that any of the provisions in these Terms and Conditions is unenforceable or invalid will not affect the enforceability or validity of the other provisions of these Terms and Conditions and is not a ground for termination.

ENTIRE AGREEMENT
These Terms and Conditions together with the Privacy Policy constitute the entire agreement between Re.Turn It Collect and you and no other communications or representations should be interpreted as being part of the agreement.

GOVERNING LAW
These Terms and Conditions and any separate agreements under which we provide you services shall be governed by and construed in accordance with the laws of New South Wales, Australia.

CHANGES TO TERMS AND CONDITIONS
You can review the most current version of the Terms and Conditions at any time at this page or other page nominated from time to time. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms and Conditions by posting updates and changes to our System. It is your responsibility to check the System periodically for changes. Your continued use of or access to the System or use of the Service following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes.

MEANING OF WORDS
Re.Turn It Collect, we, our, or us means Re.Turn It Collect Pty Ltd (ACN 626 032 291) and any related bodies corporate (as defined in the Corporations Act 2001).
